Filing 11 (IN CHAMBERS) ORDER by Judge Fernando L. Aenlle-Rocha: On October 26, 2021, the parties in Dan Aptor v. Terren S. Peizer, 2:21-cv-06371-FLA (Ex) (the "Aptor action") and Michael Anderson v. Terren S. Peizer, 2:21-cv-07998-PA (MAAx) (the "Anderson action") filed a joint stipulation to consolidate the two actions and to stay the case pending the resolution of the motion to dismiss in the related consolidated class action Michael Farhar v. Ontrak, Inc., 2:21-cv-01987-FLA (Ex) (the "Farhar action"). The allegations of the Complaints in the Aptor and Anderson actions appear to arise from the same transactions, happenings, or events and to call for determination of the same or substantially related or similar questions of law and fact as in the Farhar consolidated class action. The court, therefore, ORDERS the parties to meet and confer with Lead Plaintiff Ibinado Dick of the Farhar action and to Show Cause in writing why the Aptor and Anderson actions should not be consolidated with the Farhar action. The parties are to file a joint status report in the Aptor action by November 19, 2021 that states the positions of the parties in all three actions, including on the question of whether Plaintiff Ibinado Dick should remain the Lead Plaintiff in an action that consolidates these three actions.
