In particular, the Court: 1. DISMISSES Plaintiff's first claim for breach of contract, with leave to amend. 2. DISMISSES Plaintiff's second claim for breach of the covenant of good faith and fair dealing, with leave to amend. 3. DISMISSES Plaintiff's third claim for financial elder abuse under Cal. Civ. Code Sec. 3345, with leave to amend. Plaintiff must file a First Amended Complaint within fourteen (14) days of this Order. Otherwise, the above claims will be dismissed with prejudice. (bm)
