The Court issued a Notice of Discrepancy rejecting the request for a subpoena because "Plaintiff is responsible for downloading the pre-issued subpoenas on the courts website and NOT the clerk." #15 In response, Plaintiff filed an Ex Parte Application asking the Court to take judicial notice of his subpoena. In any case, an ex parte application is not the proper mechanism for requesting such documents. Thus, Plaintiffs Ex Parte Application #16 , is DENIED.
