Plaintiffs motion to set aside court order, dkt 26, erroneously concludes that the dismissal of the fictitiously-named defendants was a sanction for his failure to appear at the scheduling conference. As indicated in the Order Setting Scheduling Conference, the Court advises all parties that such defendants will be dismissed at the scheduling conference. Dkt. 11. In addition, the Court has set a date by which a motion to add parties or amend pleadings must be made in this case, the parties chose August 15, 2022. Dkt. 20. That date has not been continued. Therefore, the dismissal of Doe defendants will not preclude Plaintiff from adding defendants so long as the motion is made 28 days before August 15, 2022. The Court assumes plaintiff has been pursuing discovery diligently and had as a priority the identification of possible additional defendants. To the extent plaintiff has not yet been able to do so, the parties should stipulate to an extension of that date or to the addition of named defendants who have already been identified. Plaintiffs counsel failed to appear for the Scheduling Conference either in person or by Zoom. Counsel failed to advise the Court in advance of any reason why counsel would be unable to appear, nor have counsel contacted the Court since that date to explain the failure to appear. Plaintiffs counsel are ordered to show cause in writing no later than March 30, 2022 why they should not each be sanctioned in the amount of $500 for their failure to comply with this Courts orders. Payment of the sanctions by March 30, 2022 will be a sufficient response to this Order to Show Cause.
