At the hearing, Defendant's counsel was given an opportunity to supplement the allegations concerning Plaintiff's citizenship and its own citizenship. Defendant proffered no additional evidence of Plaintiff's citizenship and referred to the Notice of Interested Parties in an effort to supplement the record about its own citizenship, none of which was sufficient to overcome the failure of the Notice of Removal and the Declaration filed in support thereof to properly invoke this Court's diversity jurisdiction. Plaintiff's counsel moved to remand theaction to the Los Angeles County Superior Court based on Defendants failure to adequately allege a basis for the Court's subject matter jurisdiction in the Notice of Removal. Based on Defendant's failure to satisfy its burden of showing that diversity jurisdiction exists over this action, the Court grants Plaintiff's motion to remand. Accordingly, this action is remanded to Los Angeles County Superior Court, Case No. 21STCV46408, for lack of subject matter jurisdiction. See 28 U.S.C. 1447(c).
