Audero: Before the Court on June 14, 2022 is the parties' first informal discovery conference in this matter, which the Court names "IDC 1." The Court confers with the parties. With respect to the Privilege Documents, the parties stipulate that the Court may conduct an in camera review to determine (1) whether they are privileged in the first instance, and (2) if so, whether the crime-fraud exception applies. With respect to the Privacy Documents, the parties do not reach an agreement that fully resolves Plaintiff's challenge to Defendant's financial privacy objection. On this basis, the Court ORDERS as follows: 1. Defendant shall submit the Privilege Documents for in camera review, in a sealed envelope to Judge Audero's Chambers, by no later than June 30, 2022. 2. Defendant shall file a Notice of Lodging of Documents for In Camera Review by no later than June 30, 2022, which shall include a set of facts agreed-upon by the parties to assist the Court in its in camera review. 3. Nothing in this Order shall prevent the parties from agreeing to extend the June 30, 2022 deadline, provided such agreement is confirmed in writing. 4. Nothing in this Order shall prevent Defendant from seeking leave of the Court for an extension of this deadline. 5. The Court encourages the parties to continue meeting and conferring regarding Plaintiff's challenge to Defendants' financial privacy objection.
