Filing 62 MINUTE ORDER IN CHAMBERS by Judge Otis D. Wright, II: On May 10, 2022, the Court issued an Order granting Defendant American Honda Finance Corporations motion to dismiss without leave to amend #44 . The Court also granted Defendant Trans Union LLC's motion to dismiss with leave to amend, and granted Plaintiff Kristal Alvarez to June 10, 2022, to file her Second Amended Complaint ("SAC"). On June 9, 2022, Alvarez filed her SAC and asserted amended claims against Honda Finance #58 . As the Court dismissed Alvarez's claims against Honda Finance without leave to amend, Alvarez's SAC is improper to the extent it realleges such claims. Accordingly, the Court STRIKES Alvarez's claims against Honda Finance alleged in the SAC. On May 11, 2022, Honda Finance lodged with the Court a Proposed Judgment as to Honda Finance #45 . Honda Finance has not demonstrated that entry of the proposed partial judgment as to Honda Finance is warranted or appropriate at this time. To be clear, Alvarez's claims against Honda Finance have been dismissed without leave to amend and Alvarez may not reassert them in this action. (lc) |
