June 16, 2022 Opinion or Order Filing 19 MINUTES (IN CHAMBERS) ORDER RE: ORDER TO SHOW CAUSE by Judge Stanley Blumenfeld, Jr: Plaintiff's counsel submitted a declaration that questionably asserts that he "did not know about the motion to dismiss prior to... June 14, 2022" #18 . This assertion is, to say the least, questionable because Plaintiff's counsel, Ilan N. Rosen Janfaza, signed a joint status report on 5/31/2022, which stated: "American filed a motion to dismiss the claims for attorney's fees, punitive damages, intentional infliction of emotional distress and breach of contract. The motion to dismiss is scheduled to be heard on June 24, 2022" #12 . Either Mr. Rosen Janfaza is not being candid with the Court or he signed and filed an important case document without reading its short contents. Mr. Rosen Janfazas conduct, in its totality, is sanctionable. However, the Court elects to impose a verbal sanction in the form of this order. The Court expects that counsel will demonstrate a higher level of professional performance in the future and is admonished that any future violations shall result in appropriately escalated sanctions. The Court declines to impose any harsher sanction at this time, including granting the motion to dismiss for lack of opposition, because there does not appear to be any prejudice to Defendant American Airlines (AA), and AA does not oppose a continuance of the motion. The Court therefore continues the hearing on AA's motion to dismiss #10 until 7/29/2022 at 08:30 AM before Judge Stanley Blumenfeld Jr. Plaintiff's opposition shall be filed not later than 7/8/2022.
