ORDER DENYING REQUEST TO PROCEED WITHOUT PREPAYMENT OF FILING FEES (PRISONER NON-HABEAS CASE) . The Court does not resolve the question of indigency. Request is DENIED . Plaintiff has three prior "strikes". Plaintiff clarifies that he is a prisoner within the meaning of 28 USC 1915(h). Pursuant to 28 U.S.C. 1915(g), Plaintiff cannot proceed with this case without prepayment of filing fees. The deficiencies in the complaint cannot be cured by amendment and this case is DISMISSED WITHOUT PREJUDICE (SEE DOCUMENT FOR SPECIFICS) #2 by Judge Mark C. Scarsi. MD JS-6, Case Terminated.
