Eick: On October 28, 2022, Plaintiff filed a "Motion to Dismiss Defendant #4, etc." ("Motion"), seeking leave to dismiss the action voluntarily as against the Los Angeles County Sheriff's Department only. The Court construes the Motion as a notice of voluntary dismissal of the action as against the Los Angeles County Sheriff's Department only, pursuant to Rule 41(a) of the Federal Rules of Civil Procedure. No Defendant has filed any answer or motion for summary judgment in this action. Therefore, under Rule 41(a)(1), the action as against the Los Angeles County Sheriff's Department is deemed dismissed by operation of law. Nothing in this Order relieves Plaintiff of the obligation to comply fully with the terms of the October 11, 2022 "Order Dismissing Complaint with Leave to Amend" if Plaintiff desires to pursue this action as against any of the remaining Defendants.
