ORDER CONSOLIDATING RELATED ACTIONS, ACCEPTING SERVICE, AND APPOINTING CO-LEAD COUNSEL by Judge Dolly M. Gee: Upon Stipulation #15 , IT IS HEREBY ORDERED that: Defendants David Michery, Ignacio Novoa, Mary Winter, Kent Puckett, Mark Betor, William Miltner, Jonathan New, Jerry Alban, and Mullen Automotive, Inc. f/k/a Net Element, Inc. (the "Stipulating Defendants"), waive service of the Summons and Complaint in the Related Derivative Actions (to the extent that service has not yet been perfected on any Stipulating Defendant) and waive any defense based upon the sufficiency of service of process, etc. Witt, et al. v. Michery, et al., Case No. CV 22-05336 DMG (AGRx), and Morsy v. Michery, et al., Case No. CV 22-07139 DMG (AGRX) are consolidated for all purposes, including pre-trial proceedings and trial, under Case No. CV 22-07139 DMG (AGRx). Every pleading filed in the Consolidated Action, or in any separate action included herein, must bear the caption: In re Mullen Automotive, Inc. Derivative Litigation. All papers filed in connection with the Consolidated Action will be maintained in one file under Lead Case No. CV 22-5336-DMG (AGRx). Co-Lead Counsel for Plaintiffs Jeff Witt, Joseph Birbigalia, and Hany Morsy for the conduct of the Consolidated Action shall be: Thomas J. McKenna, Gainey McKenna & Egleston; and Laurence M. Rosen, The Rosen Law Firm, P.A. Plaintiffs and Stipulating Defendants shall file a proposed schedule in the Consolidated Action, within 30 days of the date that the Court enters this Order, and the Stipulating Defendants need not respond to the complaints in either the Witt Action or Morsy Action until the date set forth in the Court's Order regarding the forthcoming proposed schedule. The Morsy action, 2:22-CV-07139-DMG-AGR, shall be administratively closed. All material documents filed in Case No. 2:22-CV-07139-DMG-AGR are deemed to have been filed in the consolidated case.
