ORDER EXTENDING TIME TO RESPOND TO APPLICATION FOR TEMPORARY RESTRAINING ORDER by Judge Stanley Blumenfeld, Jr.: On November 1, 2022, the Drug Enforcement Administration (DEA) issued to Plaintiff Dr. David Bockoff an Order to Show Cause and Immediate Suspension of Registration that precludes him from continuing to prescribe controlled substances. Six weeks later, on December 15, Plaintiff filed this action challenging that order, together with an application for a temporary restraining order (TRO) to prevent the DEA from suspending Plaintiff's controlled substance registration. Dkt. Nos. #2 , #16 . The case was reassigned to the undersigned today. This Court has received a copy of an email sent by defense counsel to the chambers of the previously assigned judge, stating that Defendants intend to oppose the TRO and seeking an extension until 5 p.m. on Monday, December 19 to file their response. The Court grants Defendants' request in part and extends the response deadline to noon on December 19, 2022. The Court defers setting this matter for a hearing until after it has reviewed Defendants' opposition. IT IS SO ORDERED. (jgr)
