ORDER DISMISSING ACTION FAILURE TO PAY APPROPRIATE FILING FEE by Judge Fernando L. Aenlle-Rocha: On December 21, 2022, the court issued an order on Plaintiff Edward Hernandez's request to proceed in this action without prepayment ofthe filing fee #6 . The court granted Plaintiff's request and directed him tosubmit an initial partial filing fee of $40.00. Id. The court advised Plaintiff that failure to submit the initial partial filing fee within thirty (30) days could result in the dismissal of the action. Id. Plaintiff did not file a response or submit the initial partial filing fee. Additionally, court's correspondence to Plaintiff has been returned undeliverable, indicating Plaintiff has not satisfied his obligation under Local Rule 41-6 to notify the court of a change of address #7 , #8 . Accordingly, the court DISMISSES this action without prejudice. (Made JS-6. Case Terminated.) (lc)
