(IN CHAMBERS) ORDER RE PLAINTIFF WAGGING TAILS PRODUCTIONS, INC.'S NOTICE OF EX PARTE APPLICATION AND EX PARTE APPLICATION FOR TEMPORARY RESTRAINING ORDER AND ISSUANCE OF ORDER TO SHOW CAUSE RE PRELIMINARY INJUNCTION (DKT. #12 ) by Judge John A. Kronstadt. For the foregoing reasons, Plaintiff has not presently shown a sufficient basis for the issuance of the requested Temporary Restraining Order or a corresponding preliminary injunction. However, for the reasons stated in this Order, and in light of Defendants alleged actions during the pendency of this proceeding, this determination is without prejudice to a response by Plaintiff in which it addresses these matters. Consequently, on or before February 28, 2023, Plaintiff shall file any supplemental brief, not to exceed 15 pages, and any corresponding, supporting evidence, that addresses these issues and renews the Application for the Issuance of a Preliminary Injunction. The supplemental brief shall also address these issues with respect to the Motion for Default Judgment and Permanent Injunction filed by Plaintiff while the Application was under submission. A hearing on the Application and MDJ is presently scheduled for March 20, 2023, at 8:30 a.m., with the precise time for the hearing to be set upon the issuance of the final calendar for that date. At the hearing, the parties shall address whether the Application will be moot if the MDJ is granted. On or before March 7, 2023, Defendant shall file any opposition to the Application for Preliminary Injunction, not to exceed 15 pages. If Defendant makes such a filing, on or before March 10, 2023, Plaintiff shall file any reply, not to exceed five pages. IT IS SO ORDERED. (yl)
