February 23, 2023 Opinion or Order Filing 3 MINUTES (In Chambers) ORDER NOTIFYING PETITIONER OF COURT'S INTENT TO CONSTRUE MOTION AS A SECTION 2255 MOTION; ORDER SETTING BRIEFING SCHEDULE by Judge Josephine L. Staton: Within 30 days of the entry of this Order, Petitioner may withdraw his motion by filing a notice of the withdrawal of his motion. Within the same time frame, Petitioner may amend his filing to more fully state any basis for his motion. Petitioner may use the form created for the filing of a section 2255 motion, which is included with this order. However, use of this form is not required. The Clerk is directed to serve this Order, together with a blank 2255 motion packet, on Petitioner via first-class mail, and to note such service on the criminal and civil dockets referenced above. Any response to Petitioner's Motion is due thirty days of the refiling of the Motion or, if Petitioner does not withdrawal his Motion or refile his Motion, within sixty days of the entry of this Order.
