ORDER RE: STIPULATION TO REMAND FOR ADJUDICATION OF NATURALIZATION APPLICATIONAND TO DISMISS ACTION WITHOUT PREJUDICE #16 by Judge Fernando L. Aenlle-Rocha:1. Plaintiff's N-400 naturalization application is REMANDED to the United StatesCitizenship and Immigration Services ("USCIS") for adjudication. 2. USCIS shall adjudicate Plaintiff's naturalization application within 30 days of the entry of this Courts Order. 3. For purposes of this Order, this 30 day time frame is limited to the decision by USCIS on Plaintiff's application for naturalization, and does not include any decision by USCIS regarding any subsequent administrative appeal which Plaintiff may ultimately file (pursuant to 8 C.F.R. 336.2) in the event the application is denied. 4. If USCIS does not issue a decision on Plaintiff's application for naturalization within the 30 day time frame set forth above, Defendants shall not oppose any request by Plaintiff to this Court to vacate this remand order. 5. This action will be dismissed in its entirety without prejudice. 6. Each party shall bear his, her, or its own attorney's fees, costs and expenses. (MD JS-6. Case Terminated). (lc)
