Filing 7 CONSENT JUDGMENT AND ORDER #2 by Judge Fernando L. Aenlle-Rocha : Plaintiff Julie A. Su, Acting Secretary of Labor, United States Department ofLabor and Defendant Romero's Food Products Inc. have agreed to resolve the matters in controversy in this civil action and consent to the entryof this Consent Judgment in accordance herewith: RE PERMANENT INJUNCTION: Defendant, its officers, agents, etc., are permanently enjoined and restrained from violating the Fair Labor Standards Act (SEE DOCUMENT FOR SPECIFICS). RE JUDGMENT AND ORDER: JUDGMENT IS HEREBY ENTERED, pursuant Section 16(c) ofthe FLSA, 29 USC 216(c), in favor of the Secretary and against Defendant in theamount of $650,000.00. Within 60 days of the entry of this Consent Judgment, Defendant shall pay $650,000.00 in overtime pay hereby due under the FLSA and this Judgment, to EMPLOYEES ON EXHIBIT A (SEE DOCUMENT FOR COMPLIANCE REQUIREMENTS THEREOF). party shall bear their own fees, costs, andother expenses incurred by such party in connection with any stage of this proceeding, including but not limited to attorneys' fees, which may be available under the Equal Access to Justice Act, as amended, to the date of entry of the Judgment herein; and, IT IS FURTHER ORDERED that this Court retains jurisdiction of this action for purposes of enforcing compliance with the terms of this Consent Judgment.
