Wright, II: On April 26, 2023, the Court dismissed with leave to amend Plaintiffs' Complaint for failure to sufficiently allege federal subject matter jurisdiction #11 . Specifically, theCourt explained that Plaintiffs' basis for jurisdiction, diversity jurisdiction, requires diverse citizenship of all plaintiffs from all defendants, and Plaintiffs failed to adequately allege the complete citizenship of any party. The Court identified each party whose citizenship Plaintiffs failed to adequately allege and why the Complaint's allegations were deficient. Plaintiffs immediately filed a First Amended Complaint #12 . However, Plaintiffs amend some, but not all, of the deficient citizenship allegations. As with the Complaint, Plaintiffs' allegations do not satisfy their burden to establish this Court's subject matter jurisdiction. Accordingly, the Court DISMISSES Plaintiffs' First Amended Complaint, with leave to amend the jurisdictional allegations within seven (7) days of the date of this order. Failure tofile a timely amended complaint that includes adequate jurisdictional allegations in light of the authorities cited will be deemed a concession by Plaintiffs that diversity jurisdiction is lacking, and the Court will close this case.
