ORDER DISMISSING ACTION FOR LACK OF SUBJECT MATTER JURISDICTION by Judge Fernando L. Aenlle-Rocha: On May 12, 2023, the court dismissed the Complaint with 20 days leave to amend for failure to demonstrate this court has subject matter jurisdiction over the action. Dkt. 12 ("The Complaint does not identify the statutory or other basis for this court to exercise subject matter jurisdiction over Plaintiff's claims."). On May 16, 2023, Plaintiff filed the First Amended Complaint. Dkt. 13 ("FAC"). Plaintiffs First Amended Complaint alleges various statutory bases for jurisdiction, including 28 U.S.C. 2410, 28 U.S.C. 2409a (Quiet Title Act), and 5 U.S.C. 702 (Administrative Procedure Act). FAC 1. However, none of these statutes independently provide subject matter jurisdiction (SEE DOCUMENT FOR ALL SPECIFICS). Plaintiff, thus, again fails to demonstrate this court has subject matter jurisdiction over the action. Accordingly, the court DISMISSES the First Amended Complaint and the action in its entirety. See Fed. R. Civ. P. 12(h)(3). Plaintiff's Renewed Ex Parte Application for Temporary Restraining Order or Preliminary Injunction to Prevent Foreclosure Sale #14 is DENIED as moot.(Made JS-6.
