Filing 12 MINUTES (IN CHAMBERS) by Judge Mark C. Scarsi: ORDER DISMISSING CASE. Plaintiff Andrew Walker brings this action for patent infringement againstDefendant Kerns Fine Jewelry. Plaintiff also filed a request to proceed in forma pauperis. (Req., ECF No. 2.) Days after he initiated the case, Plaintiff filed a motion to transfer this action to the United States District Court for the Northern District of California. (Mot., ECF No. 4.) The Court deems the motionappropriate for decision without oral argument. On its own motion, the Court dismisses the case for improper venue. A district court may dismiss a complaint sua sponte for improper venue before a responsive pleading is filed. The Court dismisses the case and directs the Clerk to enter judgment accordingly. The motion to transfer #4 and request to proceed in forma pauperis #2 are denied as moot. (lc) |
