ORDER RE: DEFENDANT COMPOUND LABS, INCS MOTION TO DISMISS PLAINTIFFS COMPLAINT FOR FAILURE TO STATE A CLAIM, #11 by Judge Consuelo B. Marshall: Accordingly, the Court rules on Defendants Motion to Dismiss as follows: 1. Defendants Motion is GRANTED as to Plaintiffs breach of contract claim (first cause of action) with leave to amend; 2. Defendants Motion is GRANTED as to Plaintiffs breach of the implied covenant of good faith and fair dealing (second cause of action) with leave to amend; 3. Defendants Motion is DENIED as to Plaintiffs unjust enrichment claim (third cause of action); 4. Defendants Motion is GRANTED as to Plaintiffs fraud claim (fourth cause of action) with leave to amend; 5. Defendants Motion is DENIED as to Plaintiffs conversion claim (fifth cause of action); and 6. Defendants Motion is GRANTED as to Plaintiffs promissory estoppel claim (sixth cause of action) with leave to amend. Any amended complaint to correct the deficiencies identified in this Ordershall be filed no later than November 28, 2023, and shall not assert new causesof action. If Plaintiff chooses to file an amended complaint, the amendedcomplaint shall be complete and shall not refer to the prior, supersededpleading. (L.R. 15-2.) The failure to file an amended complaint by that dateshall result in dismissal of Plaintiffs first, second, fourth, and sixth causes of action with prejudice. IT IS SO ORDERED. (shb)
