MINUTES (IN CHAMBERS) ORDER GRANTING DEFENDANT'S MOTION TO DISMISS #7 by Judge Michael W. Fitzgerald. The Motion is GRANTED with leave to amend as to Plaintiff's financial elder abuse and UCL claims. This Court is dubious that any amendment will not be futile, but Plaintiff is given one and only one opportunity to amend. Plaintiffs may file a First Amended Complaint ("FAC") by no later than January 8, 2024. Defendant shall respond to the FAC, if filed, by no later than January 29, 2024. Plaintiff is warned that any future successful motion to dismiss will be granted without leave to amend.
