Filing 13 JOINT REPORT Rule 26(f) Discovery Plan ; estimated length of trial 10, filed by Plaintiff Hector A Avila.. (Harrier, Elizabeth) |
Filing 12 (In Chambers) Order by Judge Stanley Blumenfeld, Jr.: The Court has reviewed the stipulation requesting a continuance of the December 15 mandatory scheduling conference. The parties base their request on an anticipated motion to remand and on their desire not to "devote time and resources toward meeting and conferring on a case schedule and preparing a corresponding report" before the Court rules on the anticipated motion. The parties disregarded the Courts order to file a joint status report by December 5. Dkt. No. #9 . The same order also states that "a request to continue the scheduling conference will be granted only for good cause." Id. The parties' desire to avoid devoting resources to meeting and conferring or preparing a court-ordered report does not constitute good cause. The Court DENIES the stipulation. The parties shall submit the joint status report by noon on Monday, December 11, and shall be prepared to address at the December 15 hearing why they failed to timely submit the report.
