MINUTE ORDER (IN CHAMBERS) Order Dismissing Complaint (ECF 1) in Part, with Leave to Amend by Magistrate Judge Brianna Fuller Mircheff. In summary, the Court concludes that, for purposes of the screening process only, Plaintiff has stated an Eighth Amendment claim against Drs. Sekhon and Chakrabarty in their individual capacities. The rest of the Complaint is dismissed with leave to amend. Plaintiff may file a First Amended Complaint fixing the problems identified in this Order on or before April 19, 2024. Or, in the alternative, he may notify the Court in writing on or before April 19, 2024, that he will stand on his claims against Drs. Sekhon and Chakrabarty in their individual capacities only; if he does so, the Court will order service only as to those two Defendants. SEE ORDER FOR DETAILS.
