Filing 30 MINUTES (IN CHAMBERS) by Judge Mark C. Scarsi: ORDER RE:PLAINTIFF'S MOTIONS #24 , #26 AND #27 . Plaintiff James Derek Bond filed two motions. 1 First, he moves to amend his proof of service. (Mot. for Leave to Am. Summons & Proof of Service, ECF Nos. 26 and 27.) The Court grants the motion to amend the proof of service. This does not mean that the Court finds that Plaintiff properly served the summons and complaint, or that the amended proof of service actually proves service. Plaintiff says in the title of his motion that he wants an amended summons, but he does not ask for an amended summons in the text of his motion, and he does not provide an amended summons form for the Clerk to issue. That part of the motion is denied, but Plaintiff may ask for an amended summons by following Local Rule 4-1. Plaintiff also filed a motion that, on its face, indicates that he seeks leave to amend his complaint, but the attached documents are papers relevant to a motion for summary judgment. (Mot. for Leave to Am., ECF No. 24; Mem. Re: Mot. for Summ. J., ECF No. 24-1.) The Court denies the motion but will give Plaintiff an opportunity to refile it later. Plaintiffs motion for leave to amend the proof of service is granted, Plaintiffsmotion for issuance of an amended summons is denied without prejudice to renewal, and Plaintiff's motion for summary judgment is denied without prejudice to renewal. The Court cannot provide legal advice to any party, including unrepresented litigants. The Court has a Pro Se Clinic available to assist individuals who do not have an attorney to represent them (see document re Pro Se contact information). (lc) |
