| Filing 25 MINUTES (IN CHAMBERS) by Judge Otis D. Wright, II: On March 4, 2024, Plaintiff filed a First Amended Complaint, (FAC, ECF No. 21), pursuant to the Courts February 22, 2024, minute order. (Min. Order, ECF No. 17.) The Court having reviewed Plaintiffs First Amended Complaint finds Plaintiff again fails to allege federal subject matter jurisdiction on any substantive basis. (See FAC, ECF No. 21.) Rather, so far as the Court can discern from the Complaint, Plaintiff alleges all relevant California codes and statutes related to this case are inapplicable for the same assertions in Plaintiff's initialComplaint. Having reviewed the First Amended Complaint, the Court finds that Plaintiff fails to state any claim on which relief may be granted, that the Complaint is frivolous, and that Plaintiff fails to allege any basis for federal subject matter jurisdiction. Accordingly, the Court DISMISSES Plaintiff's First Amended Complaint, (ECF No. 21) with prejudice. All other dates and deadlines in this action are VACATED and taken off calendar. All pending motions are DENIED AS MOOT #18 . The Clerk of Court shall close this case. (Made JS-6. Case Terminated.) (lc) |
