April 8, 2024 Filing 11 MINUTE ORDER IN CHAMBERS by Judge Otis D. Wright, II:Plaintiff initiated this action on March 10, 2024, and submitted a Request to Proceed in Forma Pauperis (ECF No. 3). On April 4, 2024, Defendant filed a Motion to Dismiss Plaintiff's Complaint and set the hearing for May 13, 2024, at 1:30 p.m. However, on April 5, 2024, the Court denied Plaintiff's IFP Request and ordered Plaintiff to pay the full filing fee within 30 days. (Order Den. IFP, ECF No. 10.) Accordingly, to allow Plaintiff time to comply with the Court's order, the Court hereby CONTINUES the hearing on Defendants Motion from May 13, 2024, to June 24, 2024, at 1:30 PM #8 The deadline for the parties to file their respective Oppositionand Reply shall be calculated from this new hearing date. Furthermore, after dismissing Plaintiff's first action against Defendant for lack of subjectmatter jurisdiction, (see Case No. 2:23-cv-9591-ODW (MAAx), Firpo Wycoff Carr v. Panera, LLC), the Court continues to have concerns that the amount in controversy in this action exceeds $75,000 and that the Court has jurisdiction over this case. Accordingly, the Court ORDERS Plaintiff TO SHOW CAUSE, in writing only, to be received by the Court no later than May 3, 2024, for why this action should not be dismissed for lack of subject matter jurisdiction. If Plaintiff so chooses, Plaintiff is permitted to file his response to this Order under seal pursuant to Local Rule 79-5.2.2(c). Failure to timely respondto this order shall result in dismissal of the case without further warning. (lc)
