Scarsi : IT IS HEREBY STIPULATED BETWEEN THE SETTLING PARTIES Plaintiff Los Angeles Waterkeeper and defendant Strategic Materials Inc AND ORDERED AND DECREED RE THE CLEAN WATER ACT: (SEE DOCUMENT FOR ALL SPECIFICS AND RE COMPLIANCE REQUIREMENTS AND DEADLINES AS ENUMERATED HEREIN).COMPLIANCE MONITORING: Defendant agrees to partially defray costs associated with Plaintiff's monitoring of Defendant's compliance with this Consent Decree during the Term by paying Plaintiff Twenty Five Thousand Dollars ($25,000.00). Payment shall be made within forty-five (45) days of the Effective Date. ENVIRONMENTALLY BENEFICIAL PROJECT, LITIGATION FEES AND COSTS, MISSED DEADLINES, AND INTEREST: Defendant agrees to make a payment totaling Seventy-Seven Thousand Dollars ($77,000.00) to the Rose Foundation made within forty-five (45) days of the Effective Date. LA WATERKEEPER'S FEES AND COSTS: Defendant shall pay a total of Seventy Thousand Five Hundred Dollars ($70,500.00) to LA Waterkeeper to partially reimburse Plaintiff for their investigation fees and costs, expert/consultant fees and costs, reasonable attorneys fees, and other costs incurred as a result of investigating and filing the lawsuit, and negotiating a resolution of this matter be made within forty-five (45) days of the Effective Date. Upon approval and entry of this Consent Decree by the Court, this Consent Decree shall constitute a final judgment between the Plaintiff and Defendant.( MD JS-6. Case Terminated ) (lc) |
