MINUTES (IN CHAMBERS): ORDER by Judge Stephen V. Wilson: Presently before the Court is Defendants' motion for summary judgment 44 . For the reasons discussed below, the Court GRANTS IN PART and DENIES IN PART Defendants' motion for summar y judgment. The Court also BIFURCATES AND STAYS Plaintiffs' First Amendment right to petition, First Amendment retaliation, familial relationship, and spousal relationship claims. The Court ORDERS Plaintiffs to show cause why judgment shouldnt b e entered in favor of Mendenhall and the City on Plaintiffs' unreasonable search and seizure, excessive force, unconstitutional arrest, and malicious prosecution claims.
