ORDER GRANTING IN PART AND DENYING IN PART MOTIONS TO DISMISS, AND REMANDING CASES by Judge Andre Birotte Jr.: Before the Court are Motions to Dismiss filed by Defendants Renovate America, and the three local government defendants Western Riverside C ouncil of Governments, San Bernardino Associated Governments, and the County of Los Angeles. The Motions to Dismiss are GRANTED as to all of Plaintiffs' claims under TILA and HOEPA. These claims are DISMISSED WITH PREJUDICE. Because the TILA and HOEPA claims are the only claims pled against Western Riverside Council of Governments, San Bernardino Associated Governments, and the County of Los Angeles, these parties are TERMINATED from their respective cases. The motions are otherwise DENIED WITHOUT PREJUDICE. The Court declines to exercise its supplemental jurisdiction over the remaining claims, so the case is REMANDED back to state court. Each of the three member cases of this consolidated action are to be remanded back to the state court from which it was removed; remanding case to San Bernardino Superior Court, Case Number CIVDS1618459.
