ORDER RE REQUEST TO PROCEED IN FORMA PAUPERIS by Judge Dolly M. Gee: Denying #3 , #4 , #5 REQUESTS to Proceed in Forma Pauperis. IT IS FURTHER ORDERED that this case is hereby DISMISSED immediately. IT WAS RECOMMENDED that the Request to Proceed In Forma Pauperis be DENIED by Magistrate Judge Gail J. Standish. Reasons: District Court lacks jurisdiction. Failure to state a claim upon which relief can be granted. All three requests to proceed in forma pauperis [Dockets 3-5] should be denied. Plaintiffs fail to identify any viable basis for federal question jurisdiction and none is possible on the face of the Complaint, which alleges only asserted wrongful conduct by private parties (not state or federal actors) that does not implicate any federal constitutional rights. If this action is brought under 42 U.S.C. sec. 1983, no state action can exist under the facts alleged. There also is no basis for diversity jurisdiction; all parties reside at the same address in California. ( MD JS-6, Case Terminated. ) (gk)
