MINUTES (IN CHAMBERS) Minute Order Regarding Motion to Compel Arbitration ORDER by Judge James V. Selna: The Court denied Plaintiffs motion to remand, but stayed decision on the motion to compel arbitration pending the United States Supreme Court's decision in Varela v. Lamps Plus, Inc., 701 F. App'x 670, 673 (9th Cir. 2017), cert. granted, 138 S. Ct. 1697, 200 L. Ed. 2d 948 (2018). Order, Docket No. 23 at 10. The Court ordered the parties to file a joint report following the Supreme Court's decision in Lamps Plus, which the parties have filed. Order, Dkt. No. 24. For the foregoing reasons, the Court grants the motion to compel arbitration. (See document for further details.) (es)

MINUTES (IN CHAMBERS) Order Regarding Motion to Remand and Motion to Compel Arbitration by Judge James V. Selna: The Court has two motions before it. First, after removing the case to federal court, Defendant RDO Equipment Co ("RDO") filed a motion to compel arbitration. 1 Mot., Docket No. 9. Plaintiff Jennifer Harmon ("Harmon") opposed. Opp'n, Docket No. 12. RDO replied. Reply, Docket No. 16. Second, Harmon filed a motion to remand. Mot., Docket No. 14. RDO opposed the motion, and Harmon filed a reply. Opp'n, Docket No. 17; Reply, Docket No. 21. For the foregoing reasons, the Court denies the motion to remand and stays proceedings related to the motion to compel arbitration pending the Supreme Court's decision in Lamps Plus. Within ten days of the Lamps Plus decision, the parties shall submit a joint report indicating the impact of the decision on this case. (See document for further details.) (es)
