SCHEDULING NOTICE and ORDER by Judge Jesus G. Bernal. Plaintiff filed a Notice of Voluntary Dismissal on March 15, 2021 (Doc. No. 15). Plaintiff references Federal Rule of Civil Procedure 41(a)(1)(A)(ii), however the Notice of Voluntary Dismissal is not signed by all the parties. FRCP 41(a)(1)(A)(i) allows for the dismissal of an action without a court order before the opposing party serves either an answer or a motion for summary judgment. Defendant in this case has not filed an answer or a motion for summary judgment, therefore, the Court hereby construes the notice of voluntary dismissal under FRCP 41(a)(1)(A)(i). The Clerk is ordered to accept the filing and close the case. The Motion to Dismiss the Case (Dkt. No. 12) is denied as moot, and the hearing on the motion set for March 29, 2021, is VACATED.
