Filing 4 MINUTES (IN CHAMBERS) ORDER TO FILE REQUEST TO PROCEED IFP OR PAY FILING FEE by Judge Dolly M. Gee: Plaintiff is incarcerated and has neither paid the $402 filing fee for this action nor requested to proceed in forma pauperis ("IFP"). In addition, although the Clerk directed Plaintiff to correct this deficiency on or before 11/24/2022 and sent Plaintiff the Court's IFP request form, Plaintiff has taken no action in response to the Clerk's notice #2 . Accordingly, the Court ORDERS Plaintiff to pay the $402 filing fee for this matter or file a properly completed request to proceed IFP (including a certified prison trust account statement) on or before 1/6/2023. Failure to do so will result in this matter being dismissed without prejudice for failure to comply with a Court order and to prosecute the action. The Clerk shall send Plaintiff a copy of the Court's form for an incarcerated plaintiff to request to proceed IFP. Court Reporter: Not Reported. (gk) |
