ORDER REGARDING DEFENDANTS MOTION TO DISMISS [DKT. 14] AND MOTION TO STRIKE PORTIONS OF PLAINTIFFS COMPLAINT [DKT. 15] AND CONTINUING THE HEARING by Judge Sunshine Suzanne Sykes: Because the Countys Motions do not include the required attestation, the Court DECLINES TO CONSIDER it at this time. See Local Rule 7.4. The scheduled hearing on these Motions set for January 13, 2023 at 2 P.M is CONTINUED to February 17, 2023 at 2 P.M. The County is ORDERED to meet and confer with Figueroa, either by phone or in person, to determine whether they can resolve the issues raised in the Countys Motions or narrow the scope of the parties dispute. Following the conference, but no later than February 10, 2023, the County must file with the Court either: (1) A notice of withdrawal of their Motions, which the Court will accept without prejudice to the Countys ability to file any future such motion; or (2) A stipulation allowing Figueroa to file a First Amended Complaint curing the deficiencies; or (3) A declaration that states the means by which the parties met and conferred and identifying the specific areas of dispute the parties were unable to resolve.
