Reyes has filed a total of three Proofs of Service in this matter: two in connection with his original Complaint, (ECF Nos. 8, 9), and one in connection with his First Amended Complaint, (ECF No. 15). All three Proofs of Service are incomplete and defective. For these reasons, all Proofs of Service in this matter are ordered STRICKEN Reyes has filed a Motion styled as a "Motion for Declaratory Relief and Writ of Mandamus." (Mot., ECF No. 14.) Declaratory relief and mandamus are remedies available only after a proper trial; they cannot be obtained by mere motion. The Court therefore takes Reyess Motion as a Motion for a Preliminary Injunction, filed without notice to the adverse party. The Court DENIES the Motion without prejudice to moving for injunctive relief after Defendant has been brought into the case and has notice of the allegations and of Reyess filings. To the extent Reyes request that the Court appoint him a lawyer , the request is DENIED with prejudice. (ECF No. 3.) "the indigent litigant statute, 28 U.S.C. 1915(e)(1), allows courts to "request that an attorney volunteer to represent a civil litigant pro se; it does not authorize courts to compel an attorney to do so. 30.64 Acres, 795 F.2d at 798801.To the extent Reyes asks that the Court request that a lawyer volunteer to represent him in this matter, the request is DENIED without prejudice to re-filing the request at a later date, once the nature of Reyes's claims is clearer. (ECF No. 3.) Before re-filing his request for an attorney, Reyes should review the final paragraph of this Minute Order, consult with the Pro Se Clinic, and prepare and file a First Amended Complaint that states more fully the facts demonstrating how and why Defendants acted wrongfully. Reyes is GRANTED open-ended leave to file a First Amended Complaint for this purpose. The Motion for Summary Judgment is STRICKEN as premature, and without prejudice to motion practice at the appropriate time. Plaintiff is advised that the Federal Pro Se Clinic offers free information and guidance to individuals who are representing themselves in federal civil actions.
