ORDER GRANTING STIPULATION TO #1 COMPEL PLAINTIFF'S INDIVIDUAL CLAIMS TOARBITRATION, #2 DISMISS CLASS CLAIMS WITHOUT PREJUDICE AND #3 STAY PROCEEDINGSPENDING COMPLETION OF ARBITRATION #15 by Judge Fernando L. Aenlle-Rocha: 1. HSS's Mutual Agreement to Arbitrate, which was submitted to the Court in support of the Stipulation, is a valid and enforceable agreement between Plaintiff and HSS to arbitrate Plaintiff's claims alleged in this action against Defendants, and HSS and Walgreens are both entitled to enforce the Arbitration Agreement; 2. Plaintiff shall be and hereby is ordered to submit all of her individual claims being asserted in this action against Defendants to arbitration in accordance with the Arbitration Agreement; 3. The parties shall meet and confer in good faith to select a mutually agreeable arbitrator prior to Plaintiff's submission of her Demand for Arbitration to the American Arbitration Association (AAA), or if the parties are unable to reach such agreement, an arbitrator will be selected in accordance with the AAA Employment Arbitration Rules and Mediation Procedures; 4. Plaintiff's uncertified claims of putative class members, as defined in the First Amended Complaint for Damages [Dkt. 1-2], shall be and hereby are dismissed without prejudice; and 5. The remaining non-individual PAGA claims in this action shall be and hereby are stayed pending completion of the arbitration proceedings set forth in the Stipulation. (lc)
