ORDER VACATING CONFERENCE AND DISMISSING ACTION WITH PREJUDICE by Judge Stanley Blumenfeld, Jr.: On August 1, the parties filed a further joint report stating that (1) Plaintiffs surrendered the vehicle on July 31, (2) settlement funds were delivered to Plaintiffs' counsel on August 1, (3) the attorney's fee dispute has been resolved, and (4) the parties expect Plaintiffs' counsel to receive the attorney's fee check by August 6. Dkt. No. #23 . Although the filing does not expressly state that the parties' dispute has been resolved in full and that the case may be dismissed with prejudice, the Court construes this as an inadvertent omission based on the substance of the report. Accordingly, the Court VACATES the August 4 status conference and DISMISSES Plaintiffs' claims with prejudice, consistent with the parties' apparent intent. If the parties object to this approach, they shall appear in person at 8:30 a.m. on August 4 and request that the Court vacate this order nunc pro tunc. SEE ORDER FOR DETAILS. (jgr)
