ORDER RE: JOINT STIPULATION TO DISMISS CLASS CLAIMS AND SUBMIT PLAINTIFFS' INDIVIDUAL CLAIMS TO SEPARATE AND BINDING ARBITRATION by Judge Andre Birotte Jr.: Having reviewed the parties' Joint Stipulation #13 , IT IS HEREBY ORDERED that all individual claims alleged by Plaintiffs shall be submitted to separate and binding arbitration before the American Arbitration Association for each Plaintiff, pursuant to the arbitration agreements executed by Plaintiffs in connection with their employment with Defendant Shamrock Foods Company. The class claims in the Civil Action are hereby DISMISSED without prejudice. The Civil Action shall be STAYED pending arbitration of Plaintiffs' individual claims. Accordingly, it is HEREBY ORDERED that this action is administratively closed and removed from the Court's active caseload until further application by the Parties or Order of this Court. The parties are ORDERED to file a joint statue report every 120 days regarding the status of arbitration, starting from the date of this Order. The parties must file a final Joint Statute Report within ten dates after the arbitration concludes. (Made JS-6. Case Terminated.) (gk)
