January 10, 2024 Opinion or Order Filing 9 MINUTES (IN CHAMBERS) ORDER GRANTING PLAINTIFF'S REQUEST FOR AN EXTENSION (DKT. 8) by Magistrate Judge A. Joel Richlin: On December 28, 2023, Plaintiff filed a request for an extension of time to respond to the Court's Order. (Dkt. 8.) December 15, 2023 Opinion or Order Filing 7 MINUTES (IN CHAMBERS) ORDER DENYING PLAINTIFF'S REQUEST FOR REDACTION (DKT. 3) by Magistrate Judge A. Joel Richlin: denying #3 REQUEST for Order. However, under Federal Rule of Civil Procedure 5.2(h) "a person waives the protection of Rule 5.2(a) as to the person's own information by filing it without redaction and not under seal." Fed. R. Civ. P. 5.2.(h). Thus, to the extent Plaintiff filed any of his own information without redaction and now seeks to redact it under Rule 5.2(a) that request is DENIED as waived. Moreover, the Court finds no basis under the Federal Rules or the Local Rules to redact Plaintiff's mailing address, email address, or phone number as that information is not confidential. Indeed, Local Rule 5-4.8 requires pro se litigants to provide both the Court and all parties to the case with their current mailing address, telephone number, and email address for purposes of receiving filings in the case. Thus, the information Plaintiff seeks to redact is required by the Local Rules. See minute order for details. (lom)
December 15, 2023 Opinion or Order Filing 6 MINUTE ORDER (IN CHAMBERS) ORDER TO SHOW CAUSE WHY THE COMPLAINT (DKT. 1) SHOULD NOT BE DISMISSED AS UNTIMELY by Magistrate Judge A. Joel Richlin. Plaintiff therefore is ordered to show cause, no later than January 15, 2024, why this action should not be dismissed with prejudice as barred by the statute of limitations. Plaintiff is advised that his failure to timely respond to this Order to Show Cause, or his failure to show why his action is not time-barred, will result in the Court recommending that the action be dismissed. See minute order for details. (Attachments: #1 Attachment 1) (lom) Modified on 12/15/2023 (lom).
