Filing 10 ORDER GRANTING JUDGMENT CREDITOR IRVING PICARD'S MOTION FOR CHARGING ORDER [ECF NO. 2] by Judge Monica Ramirez Almadani. The Court hereby GRANTS the Motion, with the above revised interest rate, and ORDERS as follows: 1. Any and all interests of The Gerald and Barbara Keller Family Trust (the "Family Trust"), through its trustee Defendant/Judgment Debtor Gerald Keller, as trustee of the Family Trust ("Keller") in Vence Ventures, LLC be charged with the Trustee's unsatisfied $2,720,385.48 judgment against Keller, plus interest accrued at a rate of $6.71 per day, from October 13, 2021. As of March 26, 2024 (895 days since October 13, 2021), the amount of interest accrued on the judgment is $6,005.45; and, 2. Vence Ventures, LLC and its members shall pay any distributions due or becoming due to the Family Trust directly to the Trustee until the amount remaining on the judgment, plus all accrued interest and allowable costs, are paid in full. Filing 9 MINUTE ORDER (IN CHAMBERS) ORDER TO SHOW CAUSE RE CALCULATION OF INTEREST ON JUDGMENT by Judge Monica Ramirez Almadani: The Court has reviewed plaintiff's Motion for Charging Order (ECF 2) and Memorandum in Support of Motion for Charging Order (ECF 2-1). The Court has determined that the correct interest rate to be charged on the Judgment, the 1-year constant maturity Treasury yield, as published by the Board of Governors of the Federal Reserve System, for the calendar week preceding the date of the judgment (October 8, 2021), is.09%. Based on this revised interest rate, the correct amount of interest accrued per day on the judgment of $2,720,385.48 is $6.71. The Court will issue a charging order reflecting this revised interest accrual rate by March 22, 2024. Any objections to the Court's calculation shall be noticed by March 20, 2024. (bm) |
