Filing 13 MINUTES OF Show Cause Hearing held before Magistrate Judge Robert N. Block. Case called. Counsel make their appearances. The Court questions plaintiffs counsel about the statements in his just-filed declaration purporting to explain his noncompliance with the Courts prior orders that he make a written good faith settlement demand. Essentially, plaintiffs counsels excuse for not complying with the November 17, 2010 Minute Order was that he did not read in its entirety his service copy. Although plaintiffs counsel does not have a bonafide excuse for his noncompliance, the Court decides to let him off this time with just a warning, as opposed to monetary sanctions. Accordingly, in lieu of rescheduling the settlement conference, the Court directs counsel to contact the crd with new proposed dates if and when the District Judge denies defendants summary judgment motion.(see document for further details)Tape #: CS 12/14/10.Court Recorder: CourtSmart.
