In light of the parties' stipulation of dismissal filed with the Court on January 12, 2017 (Dkt. No. 42 ), and good cause appearing, the Court ORDERS that a judgment of dismissa l with prejudice be ordered in this matter. It is therefore ORDERED, ADJUDGED, AND DECREED that: A judgment of dismissal with prejudice is hereby entered against Plaintiff, and in favor of Defendant Bank of America, N.A. Plaintiff's case is hereby dismissed with prejudice, Plaintiff shall take nothing against Bank of America, N.A., and each party shall bear its own costs and fees. IT IS SO ORDERED. (dro)
October 19, 2015 Opinion or Order Filing 20 ORDER Denying Plaintiff's Motion to Remand 13 and Granting in Part and Denying in Part Defendants' Motion to Dismiss 11 by Judge Cormac J. Carney: Mr. Ko's motion to remand is DENIED. BANA's motion to dismiss is DENIED with re spec to Mr. Ko's California Civil Code 2923.7 claim, the negligence claim and the portion of the UCL claim pertaining to unlawful conduct. BANA's motion to dismiss is GRANTED without leave to amend with respect to Mr. Ko's contract, pr omissory estoppel and breach of the covenant of good faith and fair dealing claims. BANA's motion to dismiss is GRANTED with leave to amend with respect to Mr. Ko's California Civil Code 2936.3 claim, negligent misrepresentation claim, and the portions of the UCL claim pertaining to unfair business practices and fraudulent business practices. Mr. Ko will have 30 days from the issuance of this order to file an amended complaint, should he choose to do so. See document for further details. (lwag)
