ORDER by Judge Cormac J. Carney Granting Plaintiff's Motion to Remand #16 . For the foregoing reasons, the Court finds that McDade has not carried her heavy burden of demonstrating that there is no possibility Khan can state a claim against her. As she and Khan are not diverse, subject matter jurisdiction is lacking, and this action is REMANDED to Orange County Superior Court. McDade's pending motion to dismiss is DENIED WITHOUT PREJUDICE.
