Filing 45 FINDINGS OF FACT AND CONCLUSIONS OF LAW RE: CROSS MOTIONS FOR JUDGMENT signed by Judge Josephine L. Staton. As set forth herein, the Court concludes that Plaintiff has established eligibility for benefits under the Policy beginning on her first day of eligibility after expiration of the elimination period (that is, July 28, 2014 plus 182 days) and continuing through December 31, 2015. Prudential is not entitled to offset benefits due under the Policy by Plaintiffs estimated SSDI benefits. The Court remands Plaintiffs claim to the plan administrator for further action that is consistent with the terms of the Policy and this Order. IT IS SO ORDERED. (Made JS-6. Case Terminated.) (es) |
