September 21, 2017 Opinion or Order Filing 360 FINAL JUDGMENT AND ORDER FOR PERMANENT INJUNCTION AND OTHER EQUITABLE RELIEF AS TO DEFENDANTS JEREMY FOTI AND CHARLES MARSHALL by Judge Virginia A. Phillips. IT IS ORDERED that Jeremy Foti and Charles Marshall are permanently restrained and enjoined. FURTHER ORDERED that judgment in the amount of $18,146,866.34 is entered, in favor of the Commission against Jeremy Foti, jointly and severally, as equitable monetary relief. Jeremy Foti is ordered to pay the FTC this amount immediately upon th e entry of this Final Judgment. FURTHER ORDERED that judgment in the amount of $1,784,022.61 is entered in favor of Federal Trade Commission against Charles Marshall, jointly and severally, as equitable monetary relief. Charles Marshall is order ed to pay the FTC this amount immediately upon the entry of this Final Judgment. FURTHER ORDERED that Jeremy Foti and Charles Marshall, theirofficers, agents, employees, and attorneys, and all other persons in active concert or participation with a ny of them, who receive actual notice of this Final Judgment, are permanently restrained and enjoined. IT IS FURTHER ORDERED that this Court retains jurisdiction of this matter for purposes of construction, modification, and enforcement of this Final Judgment. (MD JS-6. Case Terminated.) (jp)

MacKinnon: The Court grants FTC's request for sanctions and orders defendant Charles Marshall to pay to FTC within 30 days the amount of $2,908.75 as the reasonable expenses (including attorneys fees) incurred. June 21, 2017 Opinion or Order Filing 267 ORDER RE DEFENDANT MARSHALLS FAILURE TO COMPLY WITH THE COURTS ORDER 260 by Judge Beverly Reid O'Connell. Defendant Marshall is ORDERED TO SHOW CAUSE as to why he has failed to comply with this Court's Order by not timely returning the & #036;24,500 to the Receiver and not timely providing a completed financial statement. Defendant Marshall's response to this Order is due no later than Friday, June 23, 2017 by 4:00 p.m. As the Court ordered, Defendant Marshall is incurring a $500 daily penalty for every day that passes before he returns the required funds. Thus, as of todays date, Defendant Marshall has incurred a $1,000 penalty and the total amount due to the Receiver is $25,500. (rfi)

Judgment in the amount of 18,376,499.15 is entered in favor of the Commission against defendant Vito Torchia, Jr., jointly and severally, as equitable monetary relief. FURTHER ORDERED that Vito Torchia Jr., his officers, agents, employees, and attorneys, and all other persons in active concert or participation with any of them, who receive actual notice of this Order, are permanently restrained and enjoined from directly or indirectly. FURTHER ORDERED that Judgment in the amount of $1,110,165.00 is entered in favor of the Commission against Jonathan Tarkowski, jointly and severally, as equitable monetary relief.
