Spaeth: After failing to timely file a settlement conference brief, on the morning of January 18, 2023 Defendant's counsel informed the Court that Defendant would be unavailable on the scheduled date because of a calendaring error by Defendant's counsel. The Court notes that this is the second time that the parties and the Court have selected dates for the settlement conference, only for Defendant to subsequently notify the Court it is unavailable.
