ORDER TO SHOW CAUSE WHY CASE SHOULD NOT BE DISMISSED by Magistrate Judge John D. Early. Accordingly, for the foregoing reasons and before considering the adequacy of the pleading of Plaintiff's substantive claims, the Court finds that it appears that the claims asserted in the Complaint are subject to dismissal as time barred under the applicable statute of limitations. It also appears, for the reasons set forth above, that no further amendment of the Complaint could cure that infirmity. Plaintiff is therefore ORDERED to, within 30 days from the date of this Order, to show cause, in writing, why this action should not be dismissed with prejudice.
