MINUTE ORDER IN CHAMBERS ORDER TO SHOW CAUSE RE: SUBJECT-MATTER JURISDICTION by Judge Hernan D. Vera. Court orders the following: 1. Plaintiff is ordered to show cause, in writing only, why the Court should not dismiss the action in its entirety for lack of subject-matter jurisdiction. By no later than Wednesday, January 10, 2024, Plaintiff shall file a response to this Order addressing (1) why this Court has jurisdiction notwithstanding the Second Circuit's reasoning in Tagger, 951 F.3d 124, and (2) why, in any event, the Court should not abstain from this action due to related divorce proceedings pending in Jordan, see TRO at 3. The response shall be limited to ten (10) pages in length. Failure to file a timely response will result in dismissal. No oral argument will be held on this issue.2.The hearing on Plaintiff's Ex Parte Application for Temporary Restraining Order, currently calendared for January 9, 2024, is hereby vacated.
