Filing 23 ORDER RE: INJUNCTIVE RELIEF AND DISMISSAL by Judge Andre Birotte Jr.: Upon Stipulation #22 , IT IS HEREBY ORDERED, ADJUDGED, AND DECREED that Apple has blocked all access to the Email Account (ksamini@me.com and its alias ksamimi@icloud.com) and shall retain that block pending deletion after copying of the data, as set forth below. On 3/1/2024, Apple provided Plaintiff and his counsel the information and credentials necessary to access the copy of the Email Account's data which Apple created pursuant to the consent form. Within ten days of the entry of this Order, Plaintiff shall obtain and copy such data referenced and shall immediately confirm to Apple when he has done so. Upon the confirmation from Plaintiff, Apple will permanently delete the Email Account. By 3/14/2024, Plaintiff will dismiss Apple without prejudice. If Plaintiff does not file a notice of voluntary dismissal by 3/14/2024, the parties shall file a joint status report on 3/15/2024, explaining the delay. Plaintiff and Apple will each bear their own fees and costs. Plaintiff's Ex Parte Application for Temporary Restraining Order #17 is DENIED AS MOOT. (gk) |
